These terms govern your use of our services and any agreements we enter into. By engaging with our care placement, staffing, referral or adult family home services, you agree to the following terms. Please read them carefully.
1. Scope of Services
We provide adult care services, including care placement and coordination, staffing and training, referral management, adult family home living, and managed care organization support. Our role is to connect adults and families with aged-care options, coordinate resources, recruit and train caregivers, and ensure smooth transitions. We do not replace medical or legal professionals.
2. Client and Family Responsibilities
The adult or responsible family member agrees to provide accurate information about health, mobility, medication, preferences and funding. Any change in condition or financial status must be shared promptly. Families must cooperate with care plans, scheduling and communication. Failure to share key information may affect service delivery.
3. Fees and Payment
Charges for each service will be outlined in a separate service agreement or placement contract. Payment is due as described in the contract. Late payment may result in paused services. Refunds or adjustments will be handled in line with the contract and applicable regulations.
4. Admission, Transfer and Discharge
When enrolling an adult into our adult family home or service program, we will discuss admission requirements, transfer procedures and discharge policies. Transfer may be needed if care needs exceed our capacity or licensing. Discharge may occur if contract terms are breached, payment is overdue, or the adult’s condition changes substantially.
5. Notice Period and Termination
Either party may terminate the service agreement with written notice. For adult family home residence a notice period of ___ days applies (fill as per state law). Services may be terminated immediately if there is a risk of harm, non-payment or breach of essential terms. After termination, care plans and payments will be settled in accordance with the contract.
6. Changes to Services and Contracts
We reserve the right to modify our services or terms if required by licensing, funding changes or best practice updates. We will notify you in writing of any significant changes. The terms you signed remain in effect unless you agree to updated terms.
7. Limitation of Liability
We will strive to provide safe, respectful and competent care. However, adult living and home care involve risks that cannot be completely eliminated. We are not liable for indirect, incidental or consequential damages, such as emotional distress, unless caused by proven negligence. Our liability is limited to the extent permitted by law.
8. Confidentiality and Privacy
We respect privacy and keep your personal and health information secure. We follow relevant privacy policy standards and ensure authorized access only. You agree to allow us to collect and use necessary information as described in our privacy policy.
9. Resident’s Rights and Grievance
Adults and families have the right to respectful care, privacy, informed choices, a safe environment, and to voice concerns. If you have a complaint, you may submit it in writing, and we will respond according to our grievance procedure within the regulated time frames.
10. Governing Law and Dispute Resolution
These terms are governed by the laws of the state where the adult family home is licensed. Any disputes will be resolved by negotiation and, if needed, by arbitration or court as described in the service agreement. You agree to the jurisdiction of state courts or arbitration as specified.
11. General Provisions
If any part of these terms is found invalid, it will not affect the remaining terms. These terms, along with your service agreement, form the full contract between you and us. You may not assign the agreement without our consent. Both parties waive rights not stated in this contract.
